1. I Acknowledge that equine related events maybe a dangerous activity and involves RISKS that may cause SERIOUS INJURY AND IN SOME CASES DEATH, because of the unpredictable nature and irrational behavior of horses, regardless of their training and past performance.
2. I am aware, under Oklahoma Law, an equine activity sponsor or professional shall not be liable for any injury to or the death of a participant in equine activities resulting from the inherent risk of equine activities 76 OK St. Ann.§50.1-50.4.
3. I knowing these facts and in consideration of my acceptance of this form, I voluntarily assume the risk and danger of injury or death from the inherent risk of equine activities. I hereby RELEASE, DISCHARGE AND PROMISE NOT TO SUE Flames to Hope, LLC, Robinson's Equestrian Center, event organizers, sponsors or any sponsoring organizations (hereinafter the "Releasees"), for any loss, liability, damage, or cost whatsoever arising out of or related to any loss, damage, or injury (including death) to my person or property.
4. I understand that Releasees are not animal health care providers and can not be held responsible for the health of any equine participating in this event. I know these facts and agree to release Flames to Hope, Inc. the State of Oklahoma, the Board of Directors, and their officers, employees, agents and volunteers for any loss, personal injury, accident, misfortune, or damage to me or my property, and my equine with the understanding that reasonable precautions shall be taken to ensure the health and safety of all participants and their equine.
5. I release the Releasees from any claim that such Releasees are or may be negligent in connection with my experience or ability including but not limited to training or selecting horses, maintenance, care, fit or adjustment of equestrian equipment, instruction on riding or driving skills or supervising riding or driving, equine obstacles or any other equine activity.
6. I agree to abide by and follow any instructions given or rules established by Robinson's Equestrian Center and or Event sponsors with regard to my participation in this event.
7. I expressly agree that the foregoing release and waiver of liability, assumption of risk, and indemnity agreement is governed by the State of Oklahoma and is intended to be as broad and inclusive as is permitted by Oklahoma law, and that in the event any portion of this agreement is determined to be invalid, illegal, or unenforceable, the validity, legality and enforce ability of the balance of the agreement shall not be affected or impaired in an way and shall continue in full legal force and effect.
8. I acknowledge that a negative coggins is required for all equine participating in this event and I will ensure my equine has negative coggins and is healthy and free of sickness and disease.
9. I understand that any male horses participating in this event must be gelded.
10. I acknowledge that this document is a contract and agree that if a lawsuit is filed for any injury or damage in breach of this contract, I will pay all attorney's fees and costs incurred by the Releasees in defending such an action.
